Arizona State Service Dog Laws

This is a summarized version of state laws regarding service dogs in Arizona. Please refer to the full statutes for detailed information



Public Accommodation

ARS § 11-1024

  • Any person or entity that operates a public place shall not discriminate against individuals with disabilities who use service animals if the work or tasks performed by the service animal are directly related to the individual's disability. (Class 2 Misdemeanor)

  • Law has exception for zoos or wild animal parks where service animals may come into direct contact with the animals.

SDiT Access

ARS § 11-1024

  • Service dogs in training have equal access to public places as trained service dogs

  • Trainer or person with a disability can handle a SDiT

Definitions

ARS § 11-1024

  • Arizona only recognizes dogs and miniature horses as service animals

Harassment or Interference

ARS § 13-2910

A. A person commits cruelty to animals if the person does any of the following:

  • 6. Recklessly interferes with, kills or harms a working or service animal without either legal privilege or consent of the owner. (Class 1 Misdemeanor)

  • 10. Intentionally or knowingly interferes with, kills or harms a working or service animal without either legal privilege or consent of the owner. (Class 6 Felony)

  • 11. Intentionally or knowingly allows any dog that is under the person's custody or control to interfere with, kill or cause physical injury to a service animal. (Class 6 Felony)

  • 12. Recklessly allows any dog that is under the person's custody or control to interfere with, kill or cause physical injury to a service animal. (Class 1 misdemeanor)

  • 13. Intentionally or knowingly obtains or exerts unauthorized control over a service animal with the intent to deprive the service animal handler of the service animal. (Class 6 Felony)

  • If the working or service animal was killed or disabled, to the owner or agency that owns the working or service animal and that employs the handler or to the owner or handler for the replacement and training costs of the working or service animal and for any veterinary bills.

 

Misrepresentation/ Service Dog Fraud

ARS § 11-1024

  • ​A person may not fraudulently misrepresent an animal as a service animal or service animal in training to a person or entity that operates a public place. A court or duly appointed hearing officer may impose on the person misrepresenting the animal in violation of this subsection a civil penalty of not more than two hundred fifty dollars for each violation
